Understanding Reference for a Preliminary Ruling of the Court of Justice of the EU

Description

The European Judicial Training Network (EJTN) has set up an E-Learning Course on the procedure to request a preliminary ruling of the Court of Justice of the European Union on the interpretation or validity of EU Law provisions (PRP or “Article 267 procedure”). Due to the prevailing unclarities about the applicability of Charter rights and principles at the national level and the lack of relevant Case Law, the capacity to seek for further interpretation and guidance from the side of the CJEU is a very important one in terms of bringing Charter rights and principles into practise. The Course provides an overview of

  • the interplay of the national legal orders and the EU legal order,
  • the correlation between National Courts (NCTs) and the Court of Justice of the European Union (CJEU)
