Case Study - Pension Cuts Due to Council Decision

Description

Case study based on the Case of the General Court of the CJEU Leimonia Sotiropoulou v. EU Council T‑531/14

The case is interesting in so far as it constitutes one of the very rare cases, where individuals could address a case directly to the Court referring to a direct effect of a decision by a body of the European Union.

Furthermore it can serve to discuss

  • the scope of Articles 1, 25 and 34 of the Charter and
  • the proportionality of interfering with these rights by measures in the general  interest in this case of the EU as a whole
